Go Beyond MLS: ePerks Pulls The Trigger: I am being Sued.

  • seangiorgianni · 1 year ago
Hang in there Mr. Zablotskyy! What ePerks has done/is doing is diabolical. I'll do my best to help.

In the meantime, enough has already been written about the facts and issues so I wrote a short story about your situation. You can read it here: http://frclsrtv.com/2008/06/15/zablotskyy-the-s...

If nothing else, I hope it can be a minor, mirthful distraction from your troubles.

I am sorry to hear this Vlad. I believe its natural to feel sick to your stomach. It must be very scary to be sued. You have alot of people behind you, alot of support. I will keep you and your family in my prayers. Stay strong and positive.

So, it has come to pass. Well, I just want you to know I have made a donation to your defense fund and will keep you in my thoughts throughout this ordeal. If I can do anything, please let me know and I will do my best. Stay strong, get GOOD lawyers and countersue his butt for damages and legal fees, and anything else they can think of legally. GOOD LUCK!!!

I think that everyone should be on your side on this one. When it comes down to it they are trying to censor opinions and that is not a case that anyone should be hoping corporate america wins.
  • Frank · 1 year ago
This whole thing stinks to high heaven :( Have you considered contacting the ACLU? I'm sure they would be very interested in your case. I hope you win!

Vlad, I'm not a realtor, just an office manager at a real estate company. I heard about your story through Inman News. I've read every blog posted and I can't tell you how sorry I am that this happend. If I had some extra cash, I would gladly donate. I write many blogs for our company and to think that you can't say what you're thinking is proposterous. I mean, I'm about to turn 24, and to think that someone could stop me from voicing my opinion is just crazy. I've told everyone in my office about it and I hope someone can help donate. I'm going to ask my broker if I can send out a mass e-mail to our realtor association to further help your efforts.

    Best wishes,

    Troy Steuwer

Vlad sorry to hear about all this. While I don't post as much as I would like to, I always enjoy reading your blog. Hopefully this whole thing blows over without taking a toll. I hate seeing this! Keep your chin up!

It's like those guys are shooting themselves in a foot... The amount of bad publicity this lawsuit generates will make people think twice (make that trice) before they consider signing up for eperks.

If VLAD wants to end this just send the attorneys this link. - Look at the areas I boxed in Red.

    http://www.robotstxt.org/faq/prevent.html

How do I prevent robots scanning my site?
The quick way to prevent robots visiting your site is put these two lines into the /robots.txt file on your server

I would estimate they did this around October/November and didnt change it.

Now ejerks go fire your webmaster and stop the stupid lawsuit its your webmasters fault not anyone elses.

Hello, I was just about to mention the same point but you have already done it in person Mitchell. That really does look like shooting oneself in the foot.
  • Vlad Zablotskyy · 1 year ago
    Matt,

It still looks like their website is well indexed.

All the best Vlad. ePerks is only causing themselves more public damage with this suit. By muddying the waters with their own interactions online how is one to tell what damage you "allegedly" caused and they did themselves? More than anything this is a lesson in business public relations. I'm glad you have solid representation. You ave the well wishes of the blogging community. My hat's off to Andy and Greg for supporting this cause and keeping it in the blogosphere news as well.

May you prevail against the bastards and I hope you countersue and win!

I had went and read the previous entries to learn why this happened. I think I understand everything, and my opinion that you do not deserve this kind of treatment and did not do a mistake. I hope everything will work out for you in this case.
  • justnet · 1 year ago
damn Vlad... All this crap for just doing a paid review. At least you have resisted the temptation to call them ejerks. I run 4 article directories and after reading this saga, I just checked them all for articles about ejerks. LOL, yes I really did do jerks too, just in case :)
  • Vlad Zablotskyy · 1 year ago
Jon, do Google search for "eperks" - it might give you an answer why I am on their radar. Thanks for stopping by.
  • justnet · 1 year ago
So unbelievably stupid. As they say, "you can't buy that kind of publicity" This suit is going to hurt them badly. I'm sure it already has begun to.

If nothing else this is a good example for others how not to do business. Or
at least how NOT to handle critics.

ShopToEarn is bullying bloggers, and has taken it to a new level by not only demanding that a blogger stop writing about them, but by trying to force him to take down his whole blog. Please visit my site and read about this situation. Please consider writing about this issue. The only way we can protect bloggers' rights is by standing up against these corporate bullies.

    Tracy,

Thanks for stopping by. I am having difficult time to actually locate shop
to earn from your articles. From very little I have read, "Shop to Earn"
might be a legitimate affiliate website. Again it's hard to make a decision
either way since you don't provide a link to the source. Feel free to leave
    the link here.
  • Tracy Coenen · 1 year ago
    You can start here: www.shoptoearn.net

It's not an affiliate site, really. The owner of the site is signed up with real affiliate sites like CommissionJunction and Linkshare. Members use his affiliate links with all of the companies through his membership w/ CJ and LS and then he gives them a portion of the earnings back.

I'm not saying there's anything wrong with what they're doing. Just that it's not worth $450, that people could do it on their own for free and keep the full affiliate payments for themselves, and that the program is more about recruiting than it is shopping.

Whether my opinion about the company/program is correct is now beside the point. The company is trying to silence my opinion and that of others. That's the problem. :(
  • Vlad Zablotskyy · 1 year ago
    Tracy,

Thanks for clarifying it. They rank terribly on Google I must say. Did they
file a law suit against you or did they just send some sort of "cease and
desist" notice? In either case I would recommend you to talk to an attorney.

I will do some reading on your blog. I hate for any blogger to feel the
    "chilling effects" of bullying.

By the way, for some reason this is the second time I had to recover your
comment from the spam. Are you verified with Disqus?

    Thanks for stopping by.
